The Kitchen Table

This Terms & Conditions Agreement ("Agreement") is entered into between The Kitchen Table ("Company," "we," "us," or "our"), operated by Evoked, and you, the user ("you," "your," or "User") for use of The Kitchen Table mobile application, website, and related services (collectively referred to as "Services").
By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms, please do not use our Services.
1. Acceptance of Terms
1.1 Agreement to Terms
By accessing or using The Kitchen Table, you agree to be bound by this Agreement, our Privacy Policy, and any additional terms that may apply to specific features or services. These terms constitute a legally binding agreement between you and The Kitchen Table.
1.2 Eligibility
You must be at least 18 years of age to create an account and use our Services. By creating an account, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into this Agreement
- You will use the Services in compliance with all applicable laws
- All information you provide is accurate and complete
1.3 Family Account Structure
The Kitchen Table operates on a family-based model using the "Kitchen Table" metaphor. The account creator becomes the "Table Keeper" (administrator) of their family group. By creating a family:
- You accept responsibility for managing family membership
- You agree to only invite individuals who have consented to join
- You understand that family members will have access to shared family data (meal plans, inventory, recipes, profiles)
2. Description of Services
2.1 Core Services
The Kitchen Table provides:
- Family Meal Planning: AI-assisted recipe generation and meal calendar management
- Kitchen Inventory Management: Track pantry items, expiration dates, and storage locations
- Grocery List Generation: Automated and manual shopping list creation
- Nutrition Tracking: Vitamins, minerals, and age-appropriate nutritional guidance
- Family Coordination: Cooking sessions, task assignments, and skill progression
- Family Heritage: Recipe preservation, family journal, and food story documentation
2.2 AI-Generated Content
Our Services utilize artificial intelligence (Claude by Anthropic) to generate recipe suggestions and meal plans. You acknowledge that:
- AI-generated recipes are suggestions, not professional dietary or medical advice
- You are responsible for verifying ingredient safety for your family's specific needs
- AI outputs may occasionally contain errors or unsuitable suggestions
- You should consult healthcare professionals for specific dietary requirements
2.3 Service Availability
We strive to maintain continuous service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency repairs or security updates
- Circumstances beyond our reasonable control
3. User Accounts and Family Management
3.1 Account Registration
To use The Kitchen Table, you must create an account by providing:
- Valid email address
- Secure password meeting our strength requirements
- First and last name
- Family name (for new families)
You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password confidential and secure
- Notify us immediately of any unauthorized account access
- Accept responsibility for all activities under your account
3.2 Family Roles and Permissions
The Kitchen Table uses a "Kitchen Table" role system:

3.3 Family Invitations
- Only the Table Keeper can generate and revoke invite codes
- Invite codes expire after 12 hours for security
- Family membership is limited by your subscription tier (4, 8, or 12 members)
- By accepting an invitation, new members agree to these Terms
3.4 Account Termination
You may delete your account at any time through account settings. Upon deletion:
- Your personal data will be removed according to our data retention policy
- If you are the Table Keeper, you must transfer ownership or the family will be dissolved
- Shared family data may be retained for other family members
We reserve the right to suspend or terminate accounts that:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Abuse our Services or other users
Your table will be here when you return. We do not terminate accounts for inactivity. Life happens — illness, travel, busy seasons — and we will keep the fire burning until you come back.
4. Subscription Tiers and Payment
4.1 Subscription Plans
The Kitchen Table offers the following subscription tiers:

4.2 Billing and Payment
- Subscriptions are billed monthly in advance
- Payment is processed through secure third-party payment processors
- You authorize us to charge your selected payment method
- Prices may change with 30 days' advance notice
4.3 Free Trial
New users may be eligible for a free trial period. Trial terms:
- Credit card may be required to start trial
- You will be charged automatically when the trial ends unless you cancel
- Trial offers are limited to one per household
4.4 Cancellation and Refunds
User Cancellations:
- You may cancel your subscription at any time
- Access continues until the end of your current billing period
- No refunds for partial billing periods
Refund Requests:
- Refund requests within 7 days of initial purchase may be considered

Company Cancellations:
- We reserve the right to discontinue Services with 30 days' notice
- In such cases, you will receive a prorated refund for unused time
5. User Content and Data
5.1 Your Content
You retain ownership of content you create within The Kitchen Table, including:
- Custom recipes and modifications
- Family journal entries and stories
- Heritage recipes and food memories
- Profile information and preferences
By submitting content, you grant The Kitchen Table a non-exclusive, worldwide, royalty-free license to:
- Store and process your content to provide Services
- Create backups for data protection
- Display your content to authorized family members
5.2 Content Guidelines
You agree not to submit content that:
- Infringes on intellectual property rights
- Contains illegal, harmful, or offensive material
- Violates the privacy of others
- Contains malware, spam, or malicious code
- Misrepresents your identity or affiliation
5.3 Content Moderation
We reserve the right to:
- Remove content that violates these Terms
- Suspend accounts that repeatedly violate content guidelines
- Report illegal content to appropriate authorities
6. Family Data Sharing and Privacy
6.1 Shared Family Data
When you join a family, certain data becomes shared among family members:
Shared by Default:
- Meal plans and calendar
- Inventory items
- Grocery lists
- Recipes (family recipes, not personal favorites)
- Cooking sessions and tasks
- Family preferences and settings
Personal/Private:
- Your login credentials
- Personal profile details (you control visibility)
- Individual dietary restrictions (shared with meal planning AI only)
- Personal favorites and bookmarks
6.2 Data Visibility Controls
- You can control what profile information is visible to family members
- The Table Keeper can manage family-wide privacy settings
- Detailed data sharing preferences are available in account settings
6.3 Children's Data
The Kitchen Table allows creation of profiles for family members of all ages, including children, for meal planning and nutrition tracking purposes.
- Only adult family members (18+) can create accounts
- Child profiles are managed by adult family members
- We collect minimal data for child profiles (name, age group, dietary restrictions)
- We comply with applicable children's privacy laws (COPPA)
7. Health and Nutrition Disclaimer
7.1 Not Medical Advice
The Kitchen Table provides nutritional information and meal suggestions for general informational purposes only. Our Services are NOT intended to:
- Diagnose, treat, cure, or prevent any disease
- Replace professional medical advice, diagnosis, or treatment
- Serve as a substitute for consultation with qualified healthcare providers
7.2 Nutritional Information Accuracy
While we strive for accuracy in our nutritional database:
- Nutritional values are estimates based on standard data sources
- Actual nutritional content may vary based on preparation methods, brands, and portions
- You should verify nutritional information for specific dietary needs
7.3 Allergies and Dietary Restrictions
- You are responsible for managing allergies and dietary restrictions
- AI-generated recipes attempt to respect stated restrictions but may contain errors
- Always verify ingredients before preparing meals, especially for those with severe allergies
- We are not liable for adverse reactions resulting from recipe suggestions
7.4 Assumption of Risk
You acknowledge that:
- Cooking involves inherent risks (burns, cuts, foodborne illness)
- You are responsible for safe food handling and preparation
- You assume full responsibility for implementing any recipes or suggestions
8. Intellectual Property
8.1 Our Intellectual Property
The Kitchen Table and its licensors own all rights to:
- The Kitchen Table name, logo, and branding
- Application design, code, and architecture
- Original content, including default recipes and nutritional database
- AI models and prompts (excluding user-generated content)
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the Services for personal, non-commercial purposes
- Download and use the mobile application on your personal devices
You may NOT:
- Copy, modify, or distribute our application or content
- Reverse engineer, decompile, or disassemble our software
- Use our Services for commercial purposes without written permission
- Remove or alter any proprietary notices or labels
8.3 Feedback
If you provide feedback, suggestions, or ideas about our Services, you grant us the right to use such feedback without compensation or attribution.
9. Prohibited Uses
You agree NOT to use The Kitchen Table to:
9.1 Illegal Activities
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Engage in fraudulent or deceptive practices
9.2 Harmful Conduct
- Harass, abuse, or harm other users
- Share inappropriate content with family members, especially minors
- Impersonate others or misrepresent your identity
9.3 Technical Abuse
- Attempt to gain unauthorized access to our systems
- Introduce viruses, malware, or other harmful code
- Interfere with or disrupt our Services
- Use automated systems (bots, scrapers) without permission
- Circumvent security measures or access controls
- Probe, scan, or test vulnerabilities without authorization
9.4 Commercial Exploitation
- Use our Services for unauthorized commercial purposes
- Resell or redistribute our Services
- Create competing products based on our Services
10. Third-Party Services
10.1 Payment Processing
We use third-party payment processors (e.g., Stripe) to handle transactions. Your use of payment services is subject to their terms and privacy policies.
10.2 AI Services
Recipe generation is powered by Anthropic's Claude AI. While we process your requests, Anthropic's services are subject to their terms of service.
10.3 Analytics and Monitoring
We use third-party services (e.g., Sentry) for error tracking and analytics to improve our Services. These services may collect anonymized usage data.
10.4 Third-Party Links
Our Services may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of third-party services.
11. Disclaimers and Limitations of Liability
11.1 Disclaimer of Warranties
THE KITCHEN TABLE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR COMPLETENESS OF CONTENT
We do not warrant that:
- Services will be uninterrupted, secure, or error-free
- Results obtained from Services will be accurate or reliable
- Defects will be corrected
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE KITCHEN TABLE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Personal injury or property damage
- Any damages exceeding the amount you paid us in the 12 months preceding the claim
11.3 Exceptions
Some jurisdictions do not allow limitation of certain warranties or liabilities. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless The Kitchen Table, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your content submitted to the Services
- Any dispute between you and another user
13. Force Majeure
The Kitchen Table shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, fires)
- Public health emergencies or pandemics
- War, terrorism, or civil unrest
- Government actions or regulations
- Internet or telecommunications failures
- Third-party service outages
14. Dispute Resolution
14.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us at passionevoked@icloud.com to attempt to resolve any dispute informally. We will make good faith efforts to resolve concerns within 30 days.
14.2 Arbitration Agreement
If informal resolution fails, you and The Kitchen Table agree to resolve disputes through binding arbitration rather than in court, except for:
- Small claims court actions
- Injunctive relief for intellectual property violations
14.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis. You waive your right to participate in class actions, class arbitrations, or representative actions.
14.4 Exceptions
Nothing in this section prevents either party from seeking injunctive or equitable relief in court for intellectual property infringement or unauthorized access to Services.
15. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Santa Cruz County, California.
16. Changes to Terms
16.1 Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or application, unless a longer notice period is required by law.
16.2 Notification
For material changes, we will:
- Provide at least 30 days' advance notice
- Notify you via email or in-app notification
- Indicate the effective date of changes
16.3 Continued Use
Your continued use of Services after changes become effective constitutes acceptance of the modified Terms. If you do not agree to changes, you must stop using our Services.
17. General Provisions
17.1 Entire Agreement
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and The Kitchen Table regarding use of our Services.
17.2 Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver
Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.
17.4 Assignment
You may not assign or transfer your rights under this Agreement. We may assign our rights to any affiliate or successor.
17.5 Notices
Notices to you may be sent via email to the address associated with your account. Notices to us should be sent to passionevoked@icloud.com.
17.6 Survival
Provisions that by their nature should survive termination shall survive, including but not limited to: intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.

19. Acknowledgment
BY CREATING AN ACCOUNT OR USING THE KITCHEN TABLE, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms and Conditions
- You agree to be bound by these Terms
- You are at least 18 years of age
- You have the legal capacity to enter into this Agreement
